Preventive Treaty Architecture is the design of legal instruments that prevent disputes, disclosure failures and investor-state conflict before they arise, rather than adjudicating them after the loss has occurred.

1. The problem it addresses

International resource agreements are drafted to allocate risk and then litigated when the allocation fails. That sequence is expensive, slow and asymmetric: the party with the deeper balance sheet and the longer arbitration memory tends to prevail regardless of the merits, and the underlying regulatory failure is never corrected.

The pattern repeats across investment protection, environmental performance and disclosure. A host state changes its regulatory settlement; an investor claims expropriation or breach of fair and equitable treatment; a tribunal decides years later; and neither the instrument nor the conduct that produced the dispute is altered for the next agreement.

Preventive Treaty Architecture asks a different question. Not how is this dispute resolved, but what would have had to be written, measured and monitored for it not to have arisen.

2. The three-layer model

The framework's operative core is the Dynamic Legal Harmonisation Model, which integrates three layers that are ordinarily kept apart.

Arbitration analyticsNatural language processing applied to a corpus of investor-state awards, to identify the clause structures, factual patterns and regulatory triggers that recur in successful and unsuccessful claims. The purpose is drafting intelligence: knowing which formulations have failed, and where.
Smart contract complianceObligations expressed so that performance is machine-verifiable at the point it occurs, rather than asserted in a report and tested years later. Where a duty can be evidenced automatically, the dispute over whether it was performed largely disappears.
Distributed ledger traceabilityMineral provenance and emissions data recorded so that origin and quantity are attributable, tamper-evident and independently verifiable across a supply chain that crosses jurisdictions.

3. Institutional infrastructure

A preventive instrument requires standing institutions rather than ad hoc tribunals. The framework proposes three.

4. The Model Sovereign-Investor Compact

The framework's drafting output is a model compact addressing the provisions that produce most disputes: adaptive fair and equitable treatment tied to a regulatory change reservation, graduated rather than binary expropriation, resource community inclusion including artisanal and small-scale mining, technology transfer, and a four-tier escalation ladder that exhausts preventive mechanisms before arbitration is available.

The applied chapters test the model against two asymmetric relationships: a European Union and Democratic Republic of the Congo critical minerals case, and a United Kingdom and Nigeria hydrocarbons case.

5. Why it matters commercially

The same defect that produces investor-state disputes produces market access failures. A producer that cannot evidence its emissions, its provenance or its community consent does not merely risk a claim; it risks the goods not being sold. Carbon border adjustment, deforestation due diligence and forced labour instruments all turn on evidence a producer either has or does not have at the moment it is demanded.

Preventive Treaty Architecture and OGEMEX Intel are the same argument at two scales. The framework asks what an instrument should require. The register records what instruments currently do require, and whether an organisation could prove it.

This is a research framework in development, not a finished standard and not a service offering.
